Statement 1 is correct : CBI was established in 1963 by the resolution of the Ministry of Home Affairs. Currently, it has the status of an attached office under the Ministry of personnel. Though it derives its powers from the DSPE Act, 1946, it is not formed under the provisions of any Act of the Indian parliament.

Statement 2 is not correct : CVC Act, 2003 provided a fixed 2 year term for the Director of CBI which was increased to 5 years by the CVC(Amendment) Act, 2021.
