Under Article 84 of the Constitution, a person shall be qualified to be chosen to fill a seat in Parliament only when he is a citizen of India, has subscribed an oath or affirmation according to the third schedule and is minimum of twenty five years of age.
The Representation of Peoples Act, 1951 requires that the person must be an elector for a parliamentary constituency for being qualified.

Domicile and Religion are not necessary conditions in this regard. The condition of Domicile is not valid for a person to be elected as a member of the Rajya Sabha after Parliament made amendments to that effect in 2003.
